Terms of Service

1. Acceptance of Terms

By accessing or using the Weeklift service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. The Service is operated by Caribbean Data Labs LLC ("we", "us", or "our").

2. Description of Service

Weeklift is a software-as-a-service (SaaS) application that connects to your Google Search Console (GSC) account via API, analyzes week-over-week performance changes, and delivers a plain-text automated email summary to your designated inbox.

We provide data interpretation and automated delivery. We do not provide hands-on SEO consulting, and the use of the Service does not guarantee any improvements in search engine rankings, web traffic, or revenue.

3. Account Registration and Google OAuth

To use the Service, you must register for an account and connect your GSC property using Google's OAuth authentication.

• You represent that you are the authorized owner or administrator of the GSC properties you connect to the Service.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Our access to your Google data is governed by our Privacy Policy and the Google API Services User Data Policy. You may revoke our access at any time through your Google Account Security settings.

4. Subscriptions, Payments, and Refunds

• Billing: The Service is billed on a subscription basis. All payments are securely processed by our third-party payment processor (Stripe). By providing a payment method, you authorize us to charge your subscription fees on a recurring basis.
• Cancellations: You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing cycle. You will continue to receive your weekly digests until the cycle concludes.
• Refunds: Due to the digital and automated nature of the Service, we generally do not offer refunds for partial subscription periods unless legally required or in the event of a prolonged service outage on our end.

5. User Conduct and Permitted Use

You agree to use the Service only for lawful purposes. You shall not:

• Attempt to reverse engineer, decompile, or hack the Service or its underlying infrastructure.
• Use the Service to process data for websites involved in illegal, abusive, or malicious activities.
• Resell, lease, or sub-license the automated emails or API infrastructure as a standalone service without our prior written consent.

6. Intellectual Property

All code, design, algorithms, and copy associated with the Service (excluding your raw GSC data and personal information) are the exclusive intellectual property of Caribbean Data Labs LLC. Using the Service does not grant you ownership of any of our intellectual property.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR PERFECTLY ACCURATE.

Google Search algorithms are proprietary and constantly changing. We are not responsible for fluctuations in your traffic, lost rankings, or the accuracy of the underlying data provided by the Google Search Console API.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CARIBBEAN DATA LABS LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without prior notice, if you violate these Terms or if we discontinue the Service.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Puerto Rico, without regard to its conflict of law provisions. Any legal actions or proceedings arising out of these Terms shall be brought exclusively in the applicable courts located in San Juan, Puerto Rico.

11. Changes to Terms

We may modify these Terms at any time. We will notify active users of any material changes via email prior to the changes taking effect. Continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
